Terms of Service

1. Agreement

By accessing or using Regulia ("the Service"), operated at regulia.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Regulia is a SaaS platform that helps European SMEs manage compliance with EU regulations including the European Accessibility Act (EAA), NIS2 Directive, and AI Act. The Service includes automated scanning tools, compliance dashboards, document generation, and monitoring features.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• One person or organization may not maintain multiple free accounts.
• You must be at least 16 years old to use the Service.

4. Subscriptions & Payments

• Paid plans are billed monthly through Lemon Squeezy.
• Prices are in EUR and exclude applicable VAT, which is added at checkout based on your location.
• You can cancel at any time. Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial months. If you believe a charge was made in error, contact us within 14 days.
• We reserve the right to change pricing with 30 days notice. Existing subscriptions are honored until the end of their current period.

5. Free Scanner

Our free accessibility scanner is provided as-is. It performs automated checks based on WCAG 2.1 AA criteria using axe-core. Results are informational and do not constitute legal advice or certification of compliance.

• Rate limited to prevent abuse (10 scans per minute per IP).
• You may only scan websites you own or have authorization to test.
• Scanning private networks, localhost, or internal infrastructure is blocked.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Scan websites without proper authorization
• Reverse engineer, decompile, or extract source code from the Service
• Use automated tools to scrape or extract data from the Service beyond the provided APIs
• Resell or redistribute the Service without our written consent
• Circumvent rate limits or security measures

7. Intellectual Property

The Service, including its design, code, content, and branding, is owned by Regulia. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.

You retain ownership of all data you upload to the Service. You grant us a license to process your data solely to provide the Service.

8. AI-Generated Content

Some features use AI (Google Gemini) to generate compliance documents, recommendations, and assessments. AI-generated content is provided as a starting point and should be reviewed by qualified professionals before use. Regulia does not guarantee the legal accuracy or completeness of AI-generated content.

9. Limitation of Liability

Regulia is a compliance assistance tool, not a substitute for legal advice. We do not guarantee that using the Service will make you compliant with any regulation.

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any fines, penalties, or damages arising from your reliance on the Service.
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, or consequential damages.

10. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data in accordance with GDPR.

11. Uptime & Support

• We aim for 99.9% uptime but do not guarantee it. Scheduled maintenance will be communicated in advance when possible.
• Support is available via email at hello@regulia.app.

12. Termination

• You may close your account at any time by contacting us.
• We may suspend or terminate your account if you violate these Terms, with notice when practical.
• Upon termination, your data will be deleted within 30 days unless we are legally required to retain it.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be submitted to the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.
